The cloud of taxing software as royalty

A recent Supreme Court order has resolved a decades-old problem for software taxation. It was a long wait for justice, but justice has been delivered.

The core issue was that when payment for the purchase of software was made to a non-resident seller, it was treated by the taxation authorities as “Royalty” or “Business Income” in the hands of the seller.

The SC bench was hearing a batch of 86 appeals dealing with the above issue which were grouped by the Court into four categories:

  1. software purchased directly by an end-user from a non-resident supplier;
  2. software purchased from a non-resident supplier by an Indian distributor and resold to Indian end-users;
  3. software purchased from a non-resident supplier by a non-resident distributor and resold to Indian distributors or end-users and
  4. software sold as integrated hardware unit by non-resident suppliers to Indian distributors or end-users.
After much deliberation, the SC came to the conclusion that since the payment is for sale of software and such sale of software does not find a place in the definition of ‘Royalty’ under the Tax Treaty, the income of the foreign software vendors could not be regarded as royalties under the applicable tax treaties. Accordingly, the Court also upheld that the income was not taxable in India and there was no obligation on the Indian companies to deduct tax at source under 195 of the Act.

  • From April 1, 2021, businesses with turnover above INR 500 million must issue e-invoices.
  • Starting April 1, 2021, all businesses with turnover above INR 5 billion need to print QR code on B2C supply invoices – a relaxed compliance period is available till June 30, 2021 after which penalty will be levied in case of non-implementation.
  • From April 1, 2021, new HSN codes are applicable.

Below is a list of tasks that must have been completed before the financial year closing March 31, 2021 as well as tasks to pay attention to during FY 2021-22.

Compliance tasks

  • Invoicing: While filing GSTR 1, a unique series of invoices should be raised starting April 1, 2021. It is important to note that the GSTN portal should not catch duplicate or repetitive invoice serial number during the same financial year.
  • E-invoicing: The government has mandated e-invoicing for businesses with a turnover above INR 5 billion with effect from October 1, 2020. For businesses with turnover above INR 1 billion, such e-invoicing was mandated with effect from January 1, 2021. From April 1, 2021, businesses with turnover above INR 500 million (in any financial year from FY 2017-18 onwards) are mandated to issue e-invoices.
  • ITC not available without e-invoicing: Without e-invoicing, purchaser will not be able to claim input tax credit (ITC).
  • QR coding: Starting April 1, 2021, all businesses with turnover above INR 5 billion need to print QR code on B2C supply invoices, failing which, they shall be liable to pay penalty. However, the government has waived off the penalty for non-implementation till June 30, 2021.
  • HSN code requirements: From April 1, 2021, new HSN codes will be applicable, and it is imperative for businesses to adopt the new accounting software for HSN implementation. The new HSN rules are as follows:
    • Turnover up to INR 15 million – 4 digits
    • Turnover from INR 15 million to INR 50 million – 4 digits
    • Turnover above INR 50 million – 6 digits
  • Aggregate turnover: The aggregate turnover is important for making the following decisions:
    • Whether to file GSTR 1 in FY 2021-22 on quarterly QRMP scheme or on monthly basis
    • Whether to mention HSN codes or how many digits to be mentioned
    • Whether to opt for composition scheme depending on different turnover thresholds
  • Debit or credit notes: If there are discrepancies between sales and purchase returns, debit, or credit notes must be raised for the purpose of departmental audit trial.
  • Reverse charge mechanism: Reverse charge self-invoices need to be generated for reverse charge paid and input taken on supplies received from unregistered suppliers.
  • Update the GST Registration Certificate system: To ensure that the data on the system matches the actual scenario, all the amendments, including products, address etc., need to be updated on the GST RC system.

Nokia Phones May Exit Android One

Nokia phones may be primed to get an overhaul in the software department, after years of being listed under Google’s stock software Android One programme. The information comes courtesy an XDA Developers report, which cites a LinkedIn job posting by Nokia brand owner HMD Global for a user experience designer. Even though the job description in question doesn’t quite specify a mobile software designer’s role, HMD Global does cite a new ‘services’ division in the company, suggesting that it may be looking to establish a new department to add first-party apps and services to its smartphone software.

This, it is important to note, does not particularly confirm that Nokia is looking to exit the Android One ecosystem. The UX Designer in question may also be working on other related projects under the HMD Global umbrella, and more information on it should come our way in the coming months if the company does make such a drastic change to its phone interface.

LG scraps its smartphone business as losses mount

LG Electronics said on Monday it would close down its loss-making smartphone business.

In January, the South Korean electronics giant said it was looking at all options for the division after almost six years of losses totalling around $4.5bn (£3.3bn).

LG had made many innovations including ultra-wide angle cameras, rising to third largest smartphone maker in 2013.

But bosses said the mobile phone market had become "incredibly competitive".

"LG's strategic decision to exit the incredibly competitive mobile phone sector will enable the company to focus resources in growth areas such as electric vehicle components, connected devices, smart homes, robotics and artificial intelligence," it said in a statement.

Last year it shipped 28 million phones, which compares with 256 million for Samsung, according to research firm Counterpoint.

The smartphone business is the smallest of LG's five divisions, accounting for just 7.4% of revenue. Currently its global mobile phone market share is about 2%.

Update - Google to block apps from accessing entire app list on phones

In an update, Google said that app developers will have to provide a solid reason for why the tech giant should let them access other apps on users' smartphones,

Google has now updated its Developer Programme Policy, restricting which apps are allowed to use the permission.

"Apps that have a core purpose to launch, search, or interoperate with other apps on the device may obtain scope-appropriate visibility to other installed apps on the device," Google said.

There's an exception for financial apps like banking apps and P2P wallets, which the page says "may obtain broad visibility into installed apps solely for security-based purposes."
